Terms of Service

SunnyClips · sunnyclips.com

In short
  • You must be at least 18 to hold an account. Stories are made for children aged 2 to 10, but the account is yours.
  • You pay once per story, per video. There is no subscription.
  • Downloaded videos and printed books are yours to keep.
  • Upload only people who have agreed to appear: your kids, yourself, your family.

1. The agreement

These Terms of Service (the "Terms") are a contract between you and Youkla, the operator of SunnyClips ("SunnyClips", "we", "us"). They govern your use of sunnyclips.com, the SunnyClips apps, and everything we provide through them (the "Service"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

SunnyClips sells short animated stories in which your child is the hero. You pick a story, upload one photo per character, and we make the story as a video and a printable book.

2. Who can use the Service

You must be at least 18 years old and able to enter a binding contract. You may use the Service on behalf of your family, and you are responsible for everything done under your account, including by family members you let use it.

3. Your account

You sign in with Google or with a one-time code sent to your email. There is no password to store, so keep control of that email address: anyone who can read it can sign in as you. Tell us at [email protected] if you think someone else has used your account. One person, one account; you may not share, transfer, or sell it.

4. Content you upload

You keep every right you have in the photos, text, and other material you upload ("Your Content"). You grant us a non-exclusive, worldwide, royalty-free licence to store, copy, process, and transform Your Content only as needed to run the Service for you and to produce what you asked for. That licence ends when you delete the content or your account, except for copies that remain in backups for a short period and copies we must keep by law.

You promise that:

  • You own Your Content or have permission to use it this way.
  • Every person who appears in a photo has agreed to appear, and for a child you are their parent or legal guardian, or have that person's permission.
  • Your Content does not break any law or anyone else's rights, including privacy and publicity rights.

We do not claim ownership of Your Content, we do not use it to train AI models, and we do not show it to other users.

5. What we make for you

Stories generated for your account are yours to watch, download, print, and share with family and friends for personal, non-commercial use. You may not sell them or present them as made by anyone else.

Generated content is produced by AI models from Your Content and your choices. Similar inputs from other users may produce similar results; we cannot promise that anything generated is unique, and we do not warrant that it is free of third-party claims. To the extent we hold any rights in generated content, we assign them to you on delivery, subject to your compliance with these Terms.

We may keep generated content in your library, and copies in backups, so you can return to it. We do not publish it, use it in marketing, or share it with anyone unless you share a link yourself.

6. Acceptable use

You may not use the Service to:

  • Upload a photo of anyone who has not agreed to appear, or of a child you are not the parent or guardian of without that person's permission.
  • Upload photos of public figures, or of people you do not know.
  • Try to break, scrape, reverse-engineer, overload, or bypass the limits of the Service.
  • Share your account or resell access to it.
  • Use the Service to break any law or anyone else's rights.

We may remove content, refuse a request, or suspend or close an account that breaks these rules, with or without notice, and we may report unlawful content to the authorities where the law requires or allows it.

7. Plans, payment and renewal

Each story is a one-time purchase, priced per video: one video per child, up to 5 at once. Prices show in your local currency when we sell in it (US dollars, euros, pounds, Canadian or Australian dollars), otherwise in US dollars, on the story page and at checkout.

Nothing renews. There is no subscription to keep paying for.

A payment adds one prepaid story per video to your account, and making the videos spends them. Prepaid stories from earlier SunnyClips plans never expire and pay for any story.

Payments are processed by Stripe. By subscribing you authorise us and Stripe to charge your payment method for each renewal until you cancel. If a payment fails we may retry it and pause your plan until it succeeds. Prices exclude taxes unless we say otherwise; where we must collect VAT, sales tax, or similar, it is added at checkout.

8. Cancellation and refunds

There is nothing to cancel. Every video and storybook you bought stays yours.

Every video is generated from scratch for your child after you pay, so payments are not refundable once generation has started. If a video fails, we make it again at no cost.

Consumers in the EU, UK, and other places with a statutory withdrawal right. Because the Service delivers digital content immediately, you expressly agree that delivery begins as soon as your purchase completes, and you acknowledge that you lose your right of withdrawal once it does. Nothing in these Terms limits any refund right that your local consumer law gives you and that cannot be waived.

9. Price changes

We may change prices. For an existing subscription we email you at least 30 days before a new price applies to your next renewal, and you may cancel before then. If you keep the plan, the new price applies from that renewal.

10. AI-generated content

Stories are generated by AI models and can contain mistakes: a face that is not quite right, a detail that does not match, a line that reads oddly. We build every story under the same rules so nothing scary or unsafe appears, and every story ends on the win, but watch it before you show it to your child. SunnyClips is not medical, psychological, or educational advice. If you are worried about your child's development, talk to a professional.

11. Our intellectual property

The Service, its design, code, name, logo, the moments catalogue, the story structures, the art styles, and everything else we created are ours or our licensors' and are protected by copyright, trademark, and other laws. These Terms give you a personal, non-transferable, revocable right to use the Service; they do not give you any other right in it.

12. Availability and changes to the Service

We work to keep the Service available, but it can be interrupted for maintenance, provider outages, or reasons outside our control. We may change, add, or retire features. If we retire the whole Service we will give you at least 30 days' notice by email so you can download what you made.

13. Ending your account

You can stop using the Service at any time. To close your account and delete everything tied to it, write to [email protected] from the email address on the account. We may suspend or close your account if you break these Terms, if we must by law, or if your account has been unused and unpaid for more than 24 months, in which case we email you first. When an account closes, active paid periods are not refunded except as Section 8 or the law requires, and content you downloaded stays yours.

14. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that generated content will meet your expectations. Nothing in these Terms excludes a warranty that the law says cannot be excluded.

15. Limitation of liability

To the fullest extent the law allows, Youkla and its people are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising from or related to the Service, however caused. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim, or 50 US dollars if you paid nothing.

These limits do not apply to liability for death or personal injury caused by negligence, for fraud, for wilful misconduct, or to any liability that cannot be limited by law. If you are a consumer, nothing here removes rights your local law gives you.

16. Indemnity

You will defend and compensate Youkla against claims, losses, and reasonable legal costs arising from Your Content, your use of the Service in breach of these Terms, or your breach of anyone else's rights, including a claim by a person who appears in a photo you uploaded without permission.

17. Governing law and disputes

These Terms and any dispute arising from the Service are governed by the laws of the country in which Youkla is established, without regard to conflict-of-law rules, and subject to the mandatory consumer protection rules of the country where you live.

Before starting any formal proceeding, write to [email protected] and give us 30 days to resolve the issue with you. If you are a consumer, you may bring a claim in the courts of the place where you live, and you may use the EU online dispute resolution platform where it applies. Any claim must be brought individually; you agree not to bring or join a class or representative action, to the extent the law allows such an agreement.

18. Changes to these Terms

We may update these Terms. If a change materially affects your rights we email account holders at least 14 days before it takes effect. Continuing to use the Service after that date means you accept the new Terms; if you do not, cancel before then.

19. Other terms

  • These Terms and the Privacy Policy are the whole agreement between you and us about the Service.
  • If part of these Terms is found unenforceable, the rest still applies.
  • If we do not enforce a term, we can still enforce it later.
  • You may not assign these Terms. We may assign them to a successor of the business, and we will tell you if we do.
  • We send notices to the email address on your account. You send notices to the addresses below.
  • Neither party is liable for delay or failure caused by events outside its reasonable control.
